Oklahoma Drug Possession Law: Charges, Penalties, & the Four Strikes Law

Under 63 O.S. § 2-402, it is unlawful to knowingly or intentionally possess a controlled dangerous substance (CDS) without a valid prescription or other legal authorization. Oklahoma classifies controlled substances into five schedules under the Uniform Controlled Dangerous Substances Act. Simple Possession vs. Possession With Intent to Distribute

Simple possession involves quantities consistent with personal use. When quantities are larger or when circumstantial evidence points toward distribution, prosecutors may pursue possession with intent to distribute or, at higher thresholds, drug trafficking under Oklahoma’s Trafficking in Illegal Drugs Act (63 O.S. § 2-415). Aggravated trafficking, charged when quantities are substantially higher, carries a mandatory minimum of 15 years, of which 85 percent must be served before parole eligibility.
