Types of Tort Claim Cases
There are three basic types of tort claims:
- Intentional torts, in which one party engages in intentional behavior that results in damage or injury to another party
- Negligence, in which one party injures or damages another through carelessness
- Strict liability, in which a party is held responsible for damages without the injured party having to provide proof of fault
An example of an intentional tort is a physical attack by one person against another, such as an assault. A negligent driver rear-ending another vehicle would be an example of a negligence-based tort. An example of a tort based on strict liability would be a dangerous pharmaceutical drug released to the public without sufficient clinical trials. In each case, tort law is based on the idea that the wrongdoer should be held accountable for the damages caused by his or her actions.
